Distribution of matrimonial property takes place in the case of a divorce or after one of the spouses has deceased. The spouses may have made a marriage settlement agreement or otherwise excluded marital rights to property.
In the distribution of matrimonial property, the date of death or the date of pendency of the divorce petition is important. The assets and liabilities that the spouses possess on that date are taken into account in the distribution. Thus, the distribution begins with the cataloguing of said assets and liabilities.
