KKO 2016:100, Finnish Supreme Court decision regarding the lodgement of claims in bankruptcy
The Social Insurance Institution of Finland (Kela) had granted allowances to a hospital foundation. According to the terms and conditions of the allowance, the funds had to be returned to Kela in case of a change in the foundation's ownership or if the foundation ceased or fundamentally transformed its operations. The foundation was declared bankrupt.
The Supreme Court found that the foundation was still bound by the term concerning the repayment of the allowances.
